Product Warranty

Interclypse, Inc. warrants its Equipment to be free from material defects in workmanship or materials for a period of three (3) years from date of shipment. If at any time within three (3) years after shipment the Equipment does not function as warranted, Interclypse will repair or replace it without charge.

Interclypse Hardware Products that you have purchased are free from defects in materials or workmanship under normal use during the Limited Warranty Period. The Limited Warranty Period starts on the date of shipment from Interclypse. Your dated sales or delivery receipt, shows the date of purchase of the product. You may be required to provide proof of purchase as a condition of receiving warranty service. You are entitled to hardware warranty service according to the terms and conditions of this document if a repair to your Interclypse Hardware Product is required within the Limited Warranty Period.

During the Limited Warranty Period, Interclypse will, at its discretion, repair or replace any defective component. All component parts or hardware products removed under this Limited Warranty become the property of Interclypse. In the unlikely event that your Interclypse Hardware Product has recurring failures, Interclypse, at its sole discretion, may elect to provide you with (a) a replacement unit of Interclypse choosing that is the same or equivalent to your Interclypse Hardware Product in performance or (b) to give you a refund of your purchase price (less interest) instead of a replacement. This is your exclusive remedy for defective products.

It is the customer’s responsibility to pay shipping charges to return the Equipment to us for repair or replacement. Equipment shipped back to you after warranty repair is standard Ground Shipping with the ability for the customer to upgrade the shipping method at the customer’s expense. For example, if you ship Equipment to Interclypse using two-day express shipping, Interclypse will schedule to return the repaired item to you using ground shipping, if a two-day shipping method is preferred, you will be charged the difference in price between ground and 2nd day . If any Equipment is subject to federal or state consumer warranty laws, and subject to applicable law, Interclypse statement of limited warranty included with the Equipment applies in place of these warranties. Misuse, accident, modification, unsuitable physical or operating environment, improper maintenance by you or failure caused by an item for which Interclypse is not responsible may void these warranties. THIS WARRANTY REPLACES ANY OTHER WARRANTY, AND INTERCLYPSE MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

You may not assign your rights, duties or obligations hereunder without the prior written permission of Interclypse; any attempt to make such an assignment without Interclypse permission will be null and void.

Exclusions

Interclypse does not guarantee that the operation of this product will be uninterrupted or error-free. Interclypse is not responsible for damage that occurs as a result of your failure to follow the instructions intended for the Interclypse hardware product.This Limited Warranty does not apply to expendable or consumable parts and does not extend to any product from which:

Other Exclusions are:

If the Interclypse serial number has either been removed, damaged or rendered defective

A result of an accident, misuse, abuse, contamination, improper or inadequate maintenance or calibration or other external causes

Operation outside the usage parameters stated in the user documentation that shipped with the product (including burned monitor screens and incorrect input voltage)

The use of 3rd party software, interfacing, parts or supplies not supplied by Interclypse

Improper site preparation or maintenance.

Virus infection resulting from the use of 3rd party software.Damage to movement of the equipment.

The modification or service by anyone other than Interclypse or authorized service technician that represents either Interclypse or the end user customer.

Failure to follow the product instructions or failure to perform preventive maintenance.

INTERCLYPSE IS NOT RESPONSIBLE FOR DAMAGE TO OR LOSS OF ANY PROGRAMS, DATA, OR REMOVABLE STORAGE MEDIA. INTERCLYPSE IS NOT RESPONSIBLE FOR THE RESTORATION OR REINSTALLATION OF ANY PROGRAMS OR DATA OTHER THAN SOFTWARE INSTALLED BY HP WHEN THE PRODUCT IS MANUFACTURED.

This Agreement and any order issued hereunder shall be in all respects governed by the laws of the State of Maryland without reference to conflict of law principles. The application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. The parties hereby agree that any dispute relating to the Equipment sold and software provided hereunder shall be subject to the exclusive personal jurisdiction and venue of the United States District Court for the State of Maryland.
